Energy Efficiency and Renewables Lawyers

Development of a legislative base for energy efficiency and saving began several years ago (some key delegated acts are still in the development stage). With the exception of several pilot projects in the regions, the large projects have yet to be launched.

Nevertheless, the CMS’ Energy Efficiency and Renewables group in Russia has successfully built up unique experience in applying Russian legislation in the area of energy efficiency. Notably, the lawyers at CMS, Russia have worked with the Ministry of Economic Development of the Russian Federation and the EBRD to develop draft legislation setting out the main terms and conditions of energy-service contracts concluded in Russia, with the participation of the state.

Additionally, along with the state authorities, investment and various other companies, our lawyers are working to improve the legislative framework, particularly in relation to dealing with standardisation and energy efficiency programmes, and introducing and using energy efficient technology. We also work to expose factors hindering the development of plans and projects for green investment.

Our specialists contribute to the continued improvement of legislation and are members of working groups in the Association of European Businesses, the State Duma who deal with issues of energy efficiency and saving as well as of the Russian Energy Agency and Russian-French Centre for Energy Efficiency.

The lawyers at CMS, Russia follow amendments to energy saving legislation closely and are the authors of a number of publications and presentations on the topic of energy efficiency and saving.

We advise clients on a wide range of issues in this sphere, including:

  • Adhering to the rules and regulations of energy saving and the specifics of applying them;
  • Concluding energy service contracts; 
  • Meeting the energy efficiency requirements for household appliances; 
  • Participating in tenders to conclude energy service contracts in accordance with the legislation on purchases for state needs; 
  • Structuring projects in the area of energy efficiency; 
  • Tax structuring and optimisation.
